Citation Nr: 21064931 Decision Date: 10/22/21 Archive Date: 10/22/21 DOCKET NO. 16-05 652 DATE: October 22, 2021 ORDER The appeal is dismissed. FINDING OF FACT The issue of entitlement to service connection for an acquired psychiatric disorder, to include posttraumatic stress disorder (PTSD) and depression, which was previously on appeal, was granted in an August 2021 rating decision. CONCLUSION OF LAW The criteria for dismissal have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In the present case, the Board issued a July 2020 remand for additional development of the issue of entitlement to service connection for an acquired psychiatric disorder, to include PTSD and depression. On remand, an August 2021 rating decision granted service connection for PTSD; this is a full grant of the benefit sought on appeal. There remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. This decision is intended to complete the record with respect to the issue of service connection for an acquired psychiatric disorder, as this appeal was recertified to the Board in the Veterans Appeals Control and Locator System (VACOLS) despite the full grant of benefits by the Agency of Original Jurisdiction (AOJ). M. HYLAND Veterans Law Judge Board of Veterans' Appeals Attorney for the Board M. Elias, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
