Citation Nr: 21065896 Decision Date: 10/27/21 Archive Date: 10/27/21 DOCKET NO. 15-27 883 DATE: October 27, 2021 THE ISSUE Entitlement to service connection for temporomandibular joint disorder (TMJ). ORDER Entitlement to service connection for TMJ disorder is dismissed. FINDING OF FACT The Veteran was granted service connection for a TMJ disorder in a January 2021 rating decision. CONCLUSION OF LAW The claim of entitlement to service connection for a TMJ disorder is rendered moot by the grant of service connection for the same TMJ disorder. 38 U.S.C. § 7105. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from September 1987 to December 1992. This case comes before the Board of Veterans' Appeals (Board) on appeal from an August 2013 rating decision issued by the Department of Veterans Affairs (VA) Regional Office (RO) in New Orleans, Louisiana. In November 2018, the Veteran testified before a now retired Veterans Law Judge (VLJ) at a live videoconference hearing. A transcript of the hearing is of record. This matter was previously before the Board in April 2019 and in July 2020, where it was remanded for additional development. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. The Veteran was granted service connection for a TMJ disorder in a January 2021 rating decision. Because this is considered a full grant of the benefits sought, see Grantham v. Brown, 114 F. 3d. 1156 (Fed. Cir. 1997), this issue is dismissed as moot. Michael A. Pappas Veterans Law Judge Board of Veterans' Appeals Attorney for the Board R. E. Geary, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
