Citation Nr: A21016255 Decision Date: 10/01/21 Archive Date: 10/01/21 DOCKET NO. 210203-175686 DATE: October 1, 2021 ORDER Entitlement to payment for medical expenses incurred at Aegis Science Corporation on November 25, 2020, in the amount of $100.00, is dismissed. FINDING OF FACT In a May 12, 2021, decision, the Agency of Original Jurisdiction (AOJ) granted payment for medical expenses incurred at Aegis Science Corporation on November 25, 2020, in the amount of $100.00. CONCLUSION OF LAW There being no justiciable case or controversy, the appellant's claim for payment of medical expenses incurred at Aegis Science Corporation on November 25, 2020, in the amount of $100.00, is dismissed. 38 U.S.C. § 7105. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Army from November 1943 to May 1946 during World War II, with service in the Rhineland and Central Europe. The appellant, Aegis Science Corporation, seeks reimbursement for $100.00, in medical services rendered to the Veteran on November 25, 2020. In the decision on appeal, the AOJ denied reimbursement. Following the appellant's appeal, in a May 25, 2021, administrative decision, the AOJ granted entitlement to payment for the medical expenses incurred at Aegis Science Corporation on November 25, 2020, in the amount of $100.00. As the AOJ's decision resulted in a complete grant of the benefits sought, that is, $100.00 for services rendered on May 25, 2021, the appellant's claim of entitlement payment for medical expenses incurred on November 25, 2020, in the amount of $100.00, is dismissed as moot since the benefit sought on appeal is already in effect. STEVEN D. REISS Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Joshua R. Castillo, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
