Citation Nr: A21016759 Decision Date: 10/14/21 Archive Date: 10/14/21 DOCKET NO. 210106-178334 DATE: October 14, 2021 ORDER The appeal concerning entitlement to payment of the cost of non-Department of Veterans Affairs (VA) emergency medical services provided on August 12, 2019, is dismissed. FINDING OF FACT While this appeal was pending, the Agency of Original Jurisdiction (AOJ) administratively approved the Appellant's claim for payment of the cost of an August 12, 2019, episode of care provided to the Veteran. CONCLUSION OF LAW The issue of entitlement to payment of the cost of non-VA emergency medical services provided on August 12, 2019, has been resolved in full by administrative action; the appeal is moot. 38 U.S.C. § 7105; 38 C.F.R. § 20.903. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from October 1965 to October 1968. The Appellant is a proper claimant that provided services to the Veteran. 38 U.S.C. § 1725(a)(2)(A); 38 C.F.R. § 17.123. In January 2021, the Board of Veterans' Appeals (Board) received a VA Form 10182, Decision Review Request: Board Appeal electing the Evidence Submission docket to review a September 2020 decision by a VA AOJ. The Appellant's claim for payment of the cost of an August 12, 2019, episode of care provided to the Veteran was administratively approved while this appeal was pending. In March 2020, VA approved the claim for emergency treatment provided on August 12, 2019, under 38 U.S.C. § 1725. The AOJ reported in July 2020 that an invoice for an August 12, 2019, procedure had been paid to the Appellant in a batch (number 179446). The claim was reviewed again in July 2021 and resurrected to approve an additional reimbursement of $35.98. On July 20, 2021, the Appellant received notice that the claim for the August 12, 2019, episode of care was approved in its entirety. The AOJ advised the Appellant that additional claims for the August 12, 2019, episode of care that have not yet been received could be billed directed to the AOJ. (Continued on the next page) The administrative approval for the entire August 12, 2019, episode of care constitutes a full grant of the benefits sought in this appeal. No determination remains with which the Appellant disagrees and the appeal is dismissed. 38 U.S.C. § 7105(d); 38 C.F.R. § 20.903(b). DONNIE R.
