REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran had active duty in the Marine Corps from March 1967 to November 1971. In March 2020, the Veteran submitted a VA Form 10182, Decision Review Request: Board Appeal (Notice of Disagreement), opting into the Direct Review docket for the issues on appeal. Here, the Veteran stated that he was billed $50 per session for pulmonary group rehabilitation and owed $1,200, in total, for sessions attended from November 6, 2018 to January 4, 2019. The Veteran wrote that he was previously told he would not pay any monies for the sessions and had he known of the charges, he would not have attended. The claims file includes notifications from White River Junction VA Medical Center (VAMC) dated May 2019, January 2020, and March 2020. Respectively, the May 2019 notification approved pulmonary group rehabilitation sessions from January 3, 2019 and January 4, 2019; the January 2020 notification approved sessions from November 6, 2019 to November 30, 2018; and the March 2020 notification approved sessions from December 4, 2018 to December 28, 2018. At no point were there any sessions disapproved during the claimed periods. In a May 2021 Report of Contact, VA noted that after researching all relevant databases and files, VA concluded that all claims had been paid for and there were no rejections or denials for the claimed sessions for the period from November 6, 2018 to January 4, 2019. One of the principal functions of the Board of Veterans' Appeals (Board) is to make determinations of appellate jurisdiction. 38 C.F.R. § 19.4. The Board may address questions pertaining to its jurisdictional authority to review a particular case or issue. 38 C.F.R. § 20.101(d). Therefore, there no longer remains any case or controversy over the issues which have been in the Board's jurisdiction. 38 U.S.C. §§ 5110, 5107, 7104; 38 C.F.R. §§ 19.4, 19.5, 20.101. Accordingly, the appeals must be dismissed for lack of jurisdiction. 38 U.S.C. §§ 7104(a), 7105(d)(5). L. M. BARNARD Veterans Law Judge Board of Veterans' Appeals Attorney for the Board J. Lee The Board's decision in this case is binding only with respect to the instant matter decided.
