Citation Nr: 21068190 Decision Date: 11/09/21 Archive Date: 11/09/21 DOCKET NO. 20-01 728 DATE: November 9, 2021 ORDER Entitlement to service connection for interstitial cystitis is dismissed. Entitlement to service connection for urethritis is dismissed. FINDING OF FACT On November 3, 2021, prior to the promulgation of a decision in the appeal, the Department of Veteran's Affairs (VA) Board of Veterans' Appeals (Board) received notification from the Veteran that a withdrawal of this appeal, as to the issues of entitlement to service connection for interstitial cystitis and urethritis, is requested. CONCLUSION OF LAW The criteria for withdrawal of the appeal of the claims of entitlement to service connection for interstitial cystitis and urethritis have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active duty service from June 2004 to October 2006. The Veteran was scheduled for a video conference hearing before a Veterans Law Judge (VLJ) of the Board on November 8, 2021; however, he withdrew his request for such hearing on November 3, 2021. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.205. Only an appellant, or an appellant's authorized representative, may withdraw an appeal. Id. VA regulations provide for the withdrawal of an appeal to the Board by the submission of a written request at any time before the Board issues a final decision on the merits. Id. Appeal withdrawals must be in writing and must include the name of the Veteran, the claim number, and a statement that the appeal is withdrawn. Id. (Continued on the next page) The Veteran, in the November 3, 2021, statement that comports with the pertinent VA regulations, has withdrawn this appeal of the claims of entitlement to service connection for interstitial cystitis and urethritis. Thus, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. P.M. DILORENZO Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Department of Veterans Affairs The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
