Citation Nr: 21068882 Decision Date: 11/15/21 Archive Date: 11/15/21 DOCKET NO. 20-19 646 DATE: November 15, 2021 ORDER Entitlement to a rating in excess of 30 percent for chronic diarrhea is dismissed. Entitlement to a rating in excess of 10 percent for prurigo nodularis is dismissed. FINDING OF FACT In July and August 2021, prior to the promulgation of a decision, the Board received notification from the Veteran that a withdrawal of the appeal on the issues is requested. CONCLUSIONS OF LAW 1. The criteria for withdrawal of an appeal by the Veteran with respect to the issue of entitlement to a disability rating in excess of 30 percent for chronic diarrhea have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. 2. The criteria for withdrawal of an appeal by the Veteran with respect to the issue of entitlement to a disability rating in excess of 10 percent for prurigo nodularis have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran served on active duty from September 1993 to September 1997. Dismissal The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In a July 2021 written statement and August 2021 telephone conversation, the Veteran withdrew the appeal and, hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal, and it is dismissed.
