ORDER

Service connection for hearing loss is dismissed.

Service connection for tinnitus is dismissed.

 

FINDING OF FACT

A December 2020 rating decision granted service connection for hearing loss and tinnitus.

CONCLUSIONS OF LAW

1. The criteria for dismissal of service connection for hearing loss have been met.  38 U.S.C. § 7105; 38 C.F.R. § 20.104.

2. The criteria for dismissal of service connection for tinnitus have been met.  38 U.S.C. § 7105; 38 C.F.R. § 20.104.

REASONS AND BASES FOR FINDING AND CONCLUSIONS

The Veteran served on active duty from July 1969 to July 1973. 

The claim is on appeal from a December 2013 rating decision. 

In September 2018, the Veteran testified at a Board hearing.

In an April 2019 decision, the Board reopened the previously denied claims and remanded the claims for additional development.

1. Service connection for hearing loss.

2. Service connection for tinnitus.

As noted, the Board remanded the claims in April 2019 for a new VA examination.  While the case was in remand status, the RO granted service connection for hearing loss and tinnitus effective January 29, 2013.  Thereafter in a November 2021 Appellate Brief, the Veteran requested that the "case be closed out" due to the grants of service connection.

As the benefits sought have been granted in full, the issues of service connection for hearing loss and tinnitus are no longer before the Board.  As there is no case or controversy to decide, the case is dismissed.  See 38 U.S.C. § 7105; 38 C.F.R. § 20.104(c).
