Citation Nr: 21070290 Decision Date: 11/23/21 Archive Date: 11/23/21 DOCKET NO. 17-05 926 DATE: November 23, 2021 REMANDED Entitlement to service connection for multiple myeloma is remanded. REASONS FOR REMAND The Veteran served on active duty from March 1959 to April 1962. The matter is on appeal from an August 2015 rating decision. Unfortunately, the Veteran died in March 2016 while the appeal was pending. The Appellant is the Veteran's widow, and she was substituted as the claimant in November 2016. The Board finds that the matter must be remanded. The Veteran contended that, in addition to his documented MOS, his duties included entering radioactive facilities to check meters for leakage. The Appellant testified similarly. The Veteran's performance evaluations are not associated with the claims file and may contain relevant information regarding his duties. Accordingly, the Board finds that the appeal must be remanded to search for any outstanding personnel records, to include performance evaluations. The matters are REMANDED for the following action: 1. Search for the Veteran's OPMF and any other records that would document his in-service duties. 2. If records are obtained that demonstrate radiation exposure, develop the claim as necessary. MICHELLE L. KANE Veterans Law Judge Board of Veterans' Appeals Attorney for the Board M. Lavan The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
