Citation Nr: 21070676 Decision Date: 11/24/21 Archive Date: 11/24/21 DOCKET NO. 18-06 346 DATE: November 24, 2021 REMANDED Entitlement to total disability rating based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from October 1979 to April 1981. In February 2020, the Veteran testified at a Board of Veterans' Appeals (Board) hearing presided over by the undersigned Veterans Law Judge. A transcript of the hearing is of record. This matter returns to the Board following the issuance of a March 2021 Joint Motion for Partial Remand (JMPR) issued by the Court of Appeals for Veterans Claims (CAVC). 1. Entitlement to total disability rating based on individual unemployability (TDIU) is remanded. The Veteran is seeking entitlement to TDIU. As noted in the JMPR, there may be outstanding VA medical records that should be sought before adjudication of this matter. See Dunn v. West, 11 Vet. App. 462, 466-67 (1998); Bell v. Derwinski, 2 Vet. App. 611, 613 (1992). Thus, the Board will remand the Veteran's claim for TDIU. The matters are REMANDED for the following action: 1. The RO should invite the Veteran to submit any additional evidence in support of his claim. 2. The RO should obtain any and all the Veteran's medical records from the Robert J. Dole VA medical center in Wichita or any other VA facility where he has received treatment. Additionally, the RO should obtain any and all of the Veteran's psychiatric medical records from any provider that the Veteran sees or has seen for psychiatric care. B.T.
