Citation Nr: 21071384 Decision Date: 11/30/21 Archive Date: 11/30/21 DOCKET NO. 04-40 356 DATE: November 30, 2021 ORDER Service connection for an acquired psychiatric disorder, claimed as posttraumatic stress disorder (PTSD), anxiety, and depression, is granted. FINDING OF FACT Affording the Veteran the benefit of the doubt, his current PTSD with major depressive disorder (MDD) was incurred in service. CONCLUSION OF LAW The criteria to establish service connection for PTSD with MDD have been satisfied. 38 U.S.C. §§ 1110, 5107 (b) (West 2014); 38 C.F.R. §§ 3.102, 3.303, 3.304. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from January 1967 to June 1970. This matter was last before the Board of Veterans' Appeals (Board) in June 2021 when the Board vacated a February 2021 denial because the Veteran had requested additional time to submit medical evidence. Entitlement to service connection for an acquired psychiatric disorder, to include PTSD, anxiety, and depression In February 2021 the Veteran underwent a mental health evaluation with a private clinical psychologist. After an extensive clinical interview and a thorough review of the Veteran's claims file, the examiner diagnosed the Veteran with PTSD with major depressive disorder (MDD) and opined that it was more likely than not that the Veteran's current acquired psychiatric diagnoses were related to his service. Given the new evidence received since February 2021, the Board finds that the probative evidence regarding whether the Veteran's current acquired psychiatric diagnoses of PTSD with MDD were incurred in service to be in relative equipoise.
