Citation Nr: 21071721 Decision Date: 12/01/21 Archive Date: 12/01/21 DOCKET NO. 18-28 324 DATE: December 1, 2021 ORDER The appeal for entitlement to special monthly compensation based on the need for regular aid and attendance or at the housebound rate is dismissed. FINDING OF FACT In an October 2021 written statement, the accredited representative expressly withdrew the Veteran's appeal for special monthly compensation based on the need for regular aid and attendance or at the housebound rate. CONCLUSION OF LAW The criteria for withdrawal of the appeal for special monthly compensation based on the need for regular aid and attendance or at the housebound rate are met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from November 1981 to September 1986. Withdrawal In an October 2021 written statement, the accredited representative withdrew the Veteran's appeal for special monthly compensation based on the need for regular aid and attendance or at the housebound rate. He asserted that the Veteran "is content with his entitlements and benefits." The Board of Veterans' Appeals (Board) finds that the accredited representative expressly withdrew the appeal from the denial of special monthly compensation based on the need for regular aid and attendance or at the housebound rate. A veteran or the accredited representative may withdraw a substantive appeal in writing at any time prior to the Board's promulgation of a decision. 38 C.F.R. §19.55. The Board finds that the accredited representative has effectively withdrawn the appeal for special monthly compensation based on the need for regular aid and attendance or at the housebound rate. Therefore, the Board concludes that no allegation of fact or law remains as to that issue and the appeal must be dismissed. 38 U.S.C. § 7105. J. T.
