Citation Nr: 21071788 Decision Date: 12/01/21 Archive Date: 12/01/21 DOCKET NO. 17-48 226 DATE: December 1, 2021 REMANDED Service connection for a right shoulder condition is remanded. Service connection for a trapezius strain is remanded. A disability rating higher than 30 percent for anxiety is remanded. REASONS FOR REMAND The Veteran served from April 2009 to February 2017 and from April 2018 to September 2018. These claims come before the Board of Veterans' Appeals (Board) on appeal from a February 2017 rating decision. The Veterans Claims Assistance Act of 2000 (VCAA) requires that VA make reasonable efforts to obtain relevant records that the claimant has adequately identified and authorized the VA to obtain. 38 U.S.C. § 5103A. In a case of records held by a Federal department or agency, VA shall continue their efforts to obtain these records unless it is reasonably certain that such records do not exist or that further efforts to obtain those records would be futile. Id. The record does not contain service treatment records for the Veteran's second period of active duty from April to September 2018. The record does not show that the Regional Office (RO) attempted to obtain these records. If available, these records need to be associated with the file. The matters are REMANDED for the following action: Attempt to obtain any service treatment records available for the Veteran's period of active duty service from April to September 2018. If the requested records cannot be found, or are otherwise unavailable, notify the Veteran of this fact in writing. If the records cannot be located, make a formal finding of unavailability, and attach the finding to the record. JOHN Z. JONES Veterans Law Judge Board of Veterans' Appeals Attorney for the Board P. Chalker, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
