FINDING OF FACT In September 2021, the Veteran officially withdrew his claims for service connection for diverticulosis of colon, internal hemorrhoids, hypothyroidism, anemia, pre-diabetes, colon polyps(s), GERD, BPH, hematuria, surgical removal of thyroid with scar, left knee and right shoulder osteoarthritis, right lower extremity arthritis, lumbar spondylosis / arthritis, CHF, atherosclerosis of aorta, atrial flutter, cardiomyopathy, mitral valve regurgitation, angina pectoris, anticoagulation condition, postherpetic neuralgia, and COPD with emphysema. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran served honorably in the United States Army from March 1951 to March 1953. The Board notes that the Veterans' Appeals Control and Locator System (VACOLS) continues to list active claims for service connection for prurigo nodularis (claimed as eczema) and hypertension. Upon further development, the agency of original jurisdiction (AOJ) subsequently granted the Veteran's claims for these disabilities. Therefore, as these are full grants of the benefits sought, the Veteran's claims for service connection for eczema and hypertension are no longer in appellate status. See Grantham v. Brown, 114 F. 3d 1156, 1158 (Fed. Cir. 1997). The Veteran's claims for service connection for diverticulosis of colon, internal hemorrhoids, hypothyroidism, anemia, pre-diabetes, colon polyps(s), GERD, BPH, hematuria, surgical removal of thyroid with scar, left knee and right shoulder osteoarthritis, right lower extremity arthritis, lumbar spondylosis / arthritis, CHF, atherosclerosis of aorta, atrial flutter, cardiomyopathy, mitral valve regurgitation, angina pectoris, anticoagulation condition, postherpetic neuralgia, and COPD with emphysema are dismissed. In August 2021, the agency of original jurisdiction (AOJ) issued a supplemental statement of the case (SSOC). Therein, the AOJ addressed the Veteran's claims for service connection for diverticulosis of colon, internal hemorrhoids, hypothyroidism, anemia, pre-diabetes, colon polyps(s), GERD, BPH, hematuria, surgical removal of thyroid with scar, left knee and right shoulder osteoarthritis, right lower extremity arthritis, lumbar spondylosis / arthritis, CHF, atherosclerosis of aorta, atrial flutter, cardiomyopathy, mitral valve regurgitation, angina pectoris, anticoagulation condition, postherpetic neuralgia, and COPD with emphysema. In September 2021, the Veteran submitted an Appeals Satisfaction Notice. Therein, the Veteran relayed that, "I am asking to withdraw all remaining issue(s) contained in my recent . . . Supplemental Statement of the Case (SSOC) and ask the regional office of jurisdiction to discontinue further development actions associated with this appeal." The Board notes that the Veteran's statement complies with 38 C.F.R. § 20.204 (b)(1) (form and content required for withdrawal of an appeal) because it is in writing, includes the name of the Veteran, the applicable VA claims file number, and a statement of his desire to withdraw his appeals. Withdrawal of an appeal will be deemed a withdrawal of the Notice of Disagreement and, if filed, the Substantive Appeal, as to all issues to which the withdrawal applies. 38 C.F.R. § 20.204 (c). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the Veteran or by an authorized representative. 38 C.F.R. § 20.204. In this case, the Veteran has withdrawn his appeals; hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeals and they are dismissed. DAVID L.
