Citation Nr: 21071967 Decision Date: 12/01/21 Archive Date: 12/01/21 DOCKET NO. 18-41 108 DATE: December 1, 2021 ORDER The issue of competency to handle and distribute funds is dismissed. FINDING OF FACT In a January 2020 decision, the Agency of Original Jurisdiction (AOJ) found that the Veteran is considered competent. CONCLUSION OF LAW There being no justiciable case or controversy, the issue of the Veteran's competency to handle and distribute funds is dismissed. 38 U.S.C. § 7105. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Navy from June 1978 to December 1978. In the November 2017 decision on appeal, the AOJ determined that the Veteran was not competent to handle disbursement of funds. However, in a January 2020 decision, the AOJ found that the Veteran is competent. This grant represents a complete grant of the benefit sought with regard to this issue and discussion of whether the Veteran is competent is not warranted. Accordingly, the issue of whether the Veteran is competent to handle disbursement of funds is moot as the benefit sought on appeal is already in effect. STEVEN D. REISS Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Joshua R. Castillo, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
