Citation Nr: 21072304 Decision Date: 12/02/21 Archive Date: 12/02/21 DOCKET NO. 20-26 181 DATE: December 2, 2021 ORDER Entitlement to a total disability evaluation based on individual unemployability (TDIU) is dismissed. FINDING OF FACT In January 2021, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran that he wished to withdraw his appeal for entitlement to a TDIU. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from June 1976 to June 1980. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 19.55. In January 2021, the Veteran submitted written statement requesting withdrawal of his appeal for entitlement to a TDIU. That statement included his name and claims file number. The Veteran also noted that the October 2020 rating decision granted a 100 percent permanent and total rating. In follow-up correspondence dated in November 2021, the Veteran reiterated that he intended to completely withdraw his appeal for TDIU. There remain no allegations of errors of fact or law for appellate consideration. Accordingly, the appeal is dismissed. V. Chiappetta Veterans Law Judge Board of Veterans' Appeals Attorney for the Board L. Crohe, Counsel The Board's decision in this case is binding only with respect to the instant matter decided.
