ORDER

Service connection for prostate cancer is dismissed.

FINDING OF FACT

In October 2021, the RO awarded service connection for prostate cancer.

CONCLUSION OF LAW

There being no justiciable case or controversy, the issue of service connection for prostate cancer is dismissed.  38 U.S.C. § 7105.

REASONS AND BASES FOR FINDING AND CONCLUSION

The Veteran has active service from September 1960 to September 1964 and from December 1964 to December 1965, including service at Camp Lejeune.

1. Service connection for prostate cancer

In November 2017, the RO denied service connection for prostate cancer and denied service connection for skin cancer.  The Veteran timely appealed.  In June 2020, the Board remanded these claims.  

In October 2021, the RO issued a Supplemental Statement of the Case (SSOC) that continued the prior denial of service connection for skin cancer.  In November 2021, the Veteran timely submitted a VA Form 20-0996 Request for Higher-Level Review of this SSOC, opting the issue of service connection for skin cancer into the modernized system.  The Higher-Level Review decision issued in November 2021 and has not been appealed.  

Also in October 2021, the RO awarded service connection for prostate cancer.  The award of service connection for prostate cancer represents a complete grant of the benefit sought with regard to this issue.  As the benefit sought on appeal is already in effect, the issue of service connection for prostate cancer is moot.
