Citation Nr: 21074257 Decision Date: 12/14/21 Archive Date: 12/14/21 DOCKET NO. 15-00 717 DATE: December 14, 2021 ORDER The appeal concerning entitlement to service connection for a skin disorder is dismissed. FINDING OF FACT On the record at his May 2021 Board hearing, prior to the promulgation of a decision in the appeal, the Veteran withdrew the appeal concerning entitlement to service connection for a skin disorder. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the Veteran or by his authorized representative. Except for appeals withdrawn on the record at hearings, the withdrawal must be in writing. 38 C.F.R. § 19.55. Prior to the promulgation of a decision in the appeal, the Veteran provided a sworn testimony on the record at his May 2021 Board hearing before the undersigned Veterans Law Judge that he wanted to withdraw the appeal seeking entitlement to service connection for a skin disorder. As the Veteran has withdrawn the appeal of this issue in accordance with 38 C.F.R. § 19.55, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. The present withdrawal does not affect the Veteran's appeal as to the issues of "entitlement to service connection for an acquired psychiatric disorder, to include PTSD," "entitlement to service connection for ulcerative colitis," and "entitlement to the recoupment of severance pay in the amount of $23,011.84," which were addressed in a separate Board's August 2021 decision under a different docket number. MICHAEL MARTIN Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Tariq, Nadeem, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
