Citation Nr: 21077366 Decision Date: 12/29/21 Archive Date: 12/29/21 DOCKET NO. 11-03 218 DATE: December 29, 2021 REMANDED Entitlement to total disability based on individual unemployability (TDIU). REASONS FOR REMAND The Veteran testified before the undersigned Veterans Law Judge in April 2021. A copy of the transcript has been associated with the claims file. In October 2021, the Board remanded the claim of entitlement to TDIU pending the assignment of a rating for service connection for insomnia. In November 2021, the Regional Office (RO) assigned a 10 percent rating for insomnia. However, a Supplemental Statement of the Case (SSOC) discussing entitlement to TDIU was not issued. Therefore, a remand is necessary to issue an SSOC on this issue. Manlincon v. West, 12 Vet. App. 238 (1999). The matter is REMANDED for the following action: Issue an SSOC on the issue of entitlement to TDIU. If referral for extraschedular consideration is needed, that should be undertaken. L. HOWELL Veterans Law Judge Board of Veterans' Appeals Attorney for the Board D.
