Citation Nr: A21019254 Decision Date: 12/03/21 Archive Date: 12/03/21 DOCKET NO. 210115-184904 DATE: December 3, 2021 ORDER The appeal concerning entitlement to payment of expenses for non-VA medical services provided to the Veteran from November 13 through December 4, 2020, on December 7, 2020, from December 8 through December 18, 2020, on December 21, 2020, and from December 22 through December 29, 2020 is dismissed. FINDING OF FACT Prior to the Board issuing a decision on this appeal for payment for non-VA medical services provided to the Veteran on the above-listed dates, the Agency of Original Jurisdiction (AOJ) administratively approved payment for medical services for those episodes of care. CONCLUSION OF LAW As the benefit sought on appeal has been granted and resolved by administrative action, there remains no allegation of error of fact or law concerning the issue on appeal; the appeal is therefore moot, and dismissal is appropriate. 38 U.S.C. § 7104; 38 C.F.R. § 20.104. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from March 1966 to February 1968. The appellant in this case is the vendor who provided medical services to the Veteran from November 13 through December 4, 2020, on December 7, 2020, from December 8 through December 18, 2020, on December 21, 2020, and from December 22 through December 29, 2020. The appellant filed a VA Form 10182 Decision Review Request: Board Appeal (Notice of Disagreement) in January 2021 seeking reimbursement for the medical services provided to the Veteran on the above-listed dates. Prior to the Board issuing a decision on this appeal, the record shows that Payment and Operations Management (POM) received the claims for reimbursement for the relevant episodes of care on April 26, 2021 and the claims were paid on May 5, 2021. A Report of Contact sheet from POM notifying the appellant that the claims were paid in full is also in the claims file. The record indicates that the AOJ reviewed and administratively approved payment for the non-VA medical services provided to the Veteran from November 13 through December 4, 2020, on December 7, 2020, from December 8 through December 18, 2020, on December 21, 2020, and from December 22 through December 29, 2020, representing a full grant of the benefits sought in this appeal. As a result, there is no remaining allegation of error of fact or law for appellate consideration in the present appeal. See 38 C.F.R. § 20.104. Accordingly, the Board no longer has jurisdiction over the appeal, and it is therefore dismissed. See 38 U.S.C. § 7104. L.M.
