Citation Nr: A21019263 Decision Date: 12/03/21 Archive Date: 12/03/21 DOCKET NO. 211006-189912 DATE: December 3, 2021 ORDER Entitlement to a total disability rating based on individual unemployability (TDIU) is dismissed. FINDING OF FACT In a December 2021 decision, the Board awarded the Veteran TDIU. CONCLUSION OF LAW The Board having already awarded the Veteran a TDIU, a dismissal of the claim for TDIU is warranted. 38 U.S.C. § 7105. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service in the Army from August 2001 to January 2006. In a December 2021 decision, the Board granted the Veteran a TDIU in a separate appeal. As a result, the Board finds that the issue of entitlement to TDIU is moot. A claim no longer remains over which the Board may exercise appellate jurisdiction. 38 U.S.C. §§ 7104, 7105. Accordingly, entitlement to a TDIU is dismissed. MATTHEW W. BLACKWELDER Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Jennifer M. Narvaez, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
