Citation Nr: A21019477 Decision Date: 12/07/21 Archive Date: 12/07/21 DOCKET NO. 201229-185082 DATE: December 7, 2021 ORDER The appeal concerning entitlement to payment/reimbursement of expense of non-VA medical care from Interim of Wausau Supportive Services on July 13, 2020, is dismissed. FINDING OF FACT The appellant seeks payment/reimbursement of non-VA medical services furnished on July 13, 2020, through the Veterans Community Care Program (VCCP). CONCLUSION OF LAW The Board of Veterans' Appeals (Board) has no jurisdiction to review the claim, and it must be dismissed. 38 U.S.C. § 1703(f); 38 C.F.R. § 38 C.F.R. § 20.104(c). REASONS AND BASES FOR FINDING AND CONCLUSION This matter comes before the Board of Veterans' Appeals (Board) on appeal from an October 2020 decision of the VA Office of Community Care, which denied reimbursement of the costs of non-VA medical services furnished by Interim of Wausau Supportive Services on July 13, 2020, under the Veterans Community Care Program (VCCP), due to a coding error. In the December 2020 VA Form 10182, Decision Review Request: Board Appeal, the appellant elected the Direct Review docket. Decisions under the VCCP (effective June 6, 2019), including those related to payment for services, are not appealable to the Board. 38 U.S.C. § 1703(f) ("The review of any decision under [the VCCP] shall be subject to the Department's clinical appeals process, and such decisions may not be appealed to the Board of Veterans' Appeals"). Therefore, the Board cannot review the appellant's claim, and it must be dismissed. See 38 C.F.R. § 20.104(c). The Board notes that in January 2021 the appellant submitted another VA Form 10182, Decision Review Request: Board Appeal, requesting Direct Review docket of an issue which appears to involve the payment of medical services. The AOJ responded in August 2021 by informing the appellant that the VA Form 10182 was incomplete and was not considered a valid claim and thus could not be reviewed without additional clarification. No additional clarification is on file. Kristin Haddock Veterans Law Judge Board of Veterans' Appeals Attorney for the Board A.
