Citation Nr: A21020162 Decision Date: 12/17/21 Archive Date: 12/17/21 DOCKET NO. 210210-162717 DATE: December 17, 2021 ORDER The issue of entitlement to payment of medical expenses for services provided by North American Partners in Anesthesia (NAPA) on December 27, 2019, is dismissed. FINDING OF FACT The claim for entitlement to payment of medical expenses for services provided by NAPA on December 27, 2019, was granted by the Department of Veterans Affairs (VA) Veterans Health Administration (VHA). CONCLUSION OF LAW The Board of Veterans' Appeals (Board) has no jurisdiction to review the claim, and it must be dismissed. 38 U.S.C. § 7104; 38 C.F.R. § 20.903(b). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from May 1942 to June 1946 and in January 1951. He died in October 2021. This appeal is before the Board from August 2020 decisions of the VHA, which denied payment of medical expenses for services provided by NAPA on December 27, 2019. The appellant, NAPA, appealed in February 2021. However, as reflected in VHA internal communication records, in May 2021, VHA reversed its decision regarding the December 27, 2019, services provided to the Veteran by NAPA and approved the claim. Such records confirm that the claims were set to be paid as of May 19, 2019, and included a copy of the transaction control numbers and claim payment information. As the issue on appeal has been resolved by administrative action, there no longer remains a question for appellate consideration by the Board. Therefore, the appeal must be dismissed. See 38 U.S.C. § 7104; 38 C.F.R. § 20.903(b). JONATHAN B. KRAMER Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Andrew Mack, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
