Citation Nr: A21020472 Decision Date: 12/23/21 Archive Date: 12/22/21 DOCKET NO. 210910-184189 DATE: December 23, 2021 ORDER The appeal of entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU) is dismissed. FINDING OF FACT On November 29, 2021, prior to the promulgation of a decision in the appeal, the Board received notification from the appellant, through his authorized representative, that a withdrawal of this appeal is requested. CONCLUSION OF LAW The criteria for dismissal of the appeal for a TDIU are met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from November 1965 to November 1967. The rating decision on appeal was issued in August 2021 and constitutes an initial decision; therefore, the modernized review system, also known as the Appeals Modernization Act (AMA), applies. In the September 2021 VA Form 10182, Decision Review Request: Board Appeal, the Veteran elected the Evidence Submission docket. Therefore, the Board may only consider the evidence of record at the time of the agency of original jurisdiction (AOJ) decision on appeal, as well as any evidence submitted by the Veteran or his representative with, or within 90 days from receipt of, the VA Form 10182. 38 C.F.R. § 20.303. This appeal is advanced on the Board's docket pursuant to 38 C.F.R. § 20.902(c) (2019); 38 U.S.C. § 7107 (a)(2) (2012). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. Withdrawal may be made by the appellant or by his or her authorized representative. Id. (Continued on the next page) Through his authorized representative, the Veteran requested the withdrawal of his claim for TDIU in a November 2021 written statement, explaining that he was withdrawing because entitlement to a TDIU was granted by the AOJ. The November 2021 written statement meets the requirements set forth in 38 C.F.R. § 20.205. Thus, there are no allegations of errors of fact or law for appellate consideration. 38 C.F.R. § 20.202.
