FINDING OF FACT On August 9, 2021 the Board was notified that the appellant died in August 2021. CONCLUSION OF LAW Due to the death of the appellant, the Board has no jurisdiction to adjudicate the merits of this appeal at this time. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from December 1961 to December 1963. In June of 2020, the Veteran filed a notice of disagreement (NOD) in which he requested the hearing lane under the Appeals Modernization Act (AMA) review system in response to a March 2020 rating decision that denied his claims which were filed on a Fully Developed Claim form, VA 21-526EZ, in February 2020. The Board was informed on August 9, 2021, prior to the hearing scheduled in August 2021, that the Veteran passed away. The Board would have considered the evidence of record as of the date of the rating decision as well as evidence received at the hearing or within 90 days following the hearing. 38 C.F.R. § 20.302. Unfortunately, the appellant died during the pendency of the appeal. As a matter of law, appellants' claims do not survive their deaths. Therefore, this appeal must be dismissed for lack of jurisdiction. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. There are, however, provisions in place to allow for an eligible person to take the Veteran's place in his appeal in order to get a final decision. This process is called substitution. The request to be substituted must be filed within one year of the Veteran's death. 38 C.F.R. § 3.1010(b).
