Citation Nr: 21006015 Decision Date: 02/03/21 Archive Date: 02/03/21 DOCKET NO. 17-17 610 DATE: February 3, 2021 REMANDED Entitlement to a rating in excess of 10 percent prior to November 5, 2019, for residuals of right ankle fracture is remanded. Entitlement to a rating in excess of 20 percent from November 5, 2019, for residuals of right ankle fracture is remanded. REASONS FOR REMAND The Veteran had active service from December 1959 to September 1961. In September 2020, the Board remanded to obtain all outstanding treatment records, including those associated with private treatment through K.P. Emergency Room. On November 3, 2020, the Veteran informed VA that K.P. was mailing him the records and that he would then submit them to VA. On November 30, 2020, VA received a compact disc with the K.P. records from the Veteran. On December 1, 2020, VA returned the appeal to the Board. The K.P. records have not been uploaded into the file or adjudicated. It appears that the records were unable to be scanned because “no password/Password invalid.” The Veteran was not requested to provide a password or informed that the records were not scanned. This must be done. The matters are REMANDED for the following action: Undertake development to associate the K.P. treatment records, submitted on compact disc on November 30, 2020, with the record, such as requesting the password from the Veteran. T. REYNOLDS Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board N. Snyder, counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
