Citation Nr: 21006841 Decision Date: 02/05/21 Archive Date: 02/05/21 DOCKET NO. 19-25 991A DATE: February 5, 2021 REMANDED Entitlement to an initial rating higher than 20 percent for peripheral neuropathy of the right lower extremity is remanded. Entitlement to an initial rating higher than 20 percent for peripheral neuropathy of the left lower extremity is remanded. REASONS FOR REMAND The Veteran served on active duty from June 1967 to March 1972. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a June 2018 rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). In June 2020, the Board remanded the matter for development including associating any new VA treatment records with the Veteran’s claims file. Unfortunately, new VA treatment records were not uploaded into the file on remand. The Veteran has a right to substantial compliance with directives of a Board decision, and therefore the Board must remand again to ensure this compliance. Dyment v. West, 13 Vet. App. 141, 146–47 (1999); Stegall v. West, 11 Vet. App. 268, 271 (1998). The matters are REMANDED for the following action: (This appeal has been advanced on the docket. Expedited handling is requested.) 1. Associate with the Veteran’s claims file any VA treatment records not already of record (the most recent of record are from August 2019). If no new records have been generated since this time, please make a note of this in the claims file. 2. After the above development and any other development deemed necessary is completed, issue a supplemental statement of the case readjudicating the Veteran’s claims based on any new evidence and all other evidence of record. K. Parakkal Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board M. Davis, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
