Citation Nr: 21008164 Decision Date: 02/11/21 Archive Date: 02/11/21 DOCKET NO. 20-16 214 DATE: February 11, 2021 ORDER The claim for service connection for posttraumatic stress disorder (PTSD), to include as due to military sexual trauma, is dismissed. FINDING OF FACT In February 2021, at the pre-hearing conference, the Veteran, through his authorized representative notified the Board that he wished to withdraw his claim of service connection for PTSD, to include as due to military sexual trauma. CONCLUSION OF LAW The criteria for withdrawal of service connection for PTSD, to include as due to military sexual trauma, have been met. 38 U.S.C.§ 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from March 1976 to July 1977. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. Withdrawal may be made by the Veteran or by his authorized representative. Id. In the present case, the Veteran, through his representative, expressly withdrew the appeal of his service connection claim. No allegations of errors of fact or law for appellate consideration with respect to these specific matters were raised. Accordingly, the Board does not have jurisdiction to review the appeal of this issue and it is therefore dismissed. MATTHEW W. BLACKWELDER Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board H. Yoo, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided.
