Citation Nr: 21009121 Decision Date: 02/19/21 Archive Date: 02/19/21 DOCKET NO. 15-09 025 DATE: February 19, 2021 ORDER The appeal regarding entitlement to a compensable rating for keratosis pilaris prior to March 13, 2015, and entitlement to a rating in excess of 60 percent thereafter, is dismissed. FINDING OF FACT In January 2021, prior to the promulgation of a decision in the appeal, the Board of Veterans’ Appeals (Board) received notification from the Veteran that she wished to withdraw all remaining issues associated with her appeal. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from May 2006 to December 2011 and, then, during the appeal period from June 2019 to July 2020. She appealed a May 2014 rating decision denying a compensable rating for her service-connected keratosis pilaris. In November 2018, the Board remanded the issue to obtain a VA examination to assess the current severity of the skin condition. Subsequent to this development, the AOJ increased the Veteran’s rating to 60 percent, effective March 13, 2015 with entitlement to a noncompensable rating during her return to active duty service. See December 2020 rating decision. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. See 38 C.F.R. § 19.55. Withdrawal may be made by the Veteran or by her authorized representative. Id. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In a January 2021 correspondence, the Veteran explicitly and unambiguously withdrew her appeal regarding an increased rating for her service-connected keratosis pilaris. See January 2021 Appeals Satisfaction Notice. Accordingly, the appeal is dismissed. See 38 U.S.C. § 7105, 38 C.F.R. § 19.55. DONNIE R. HACHEY Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board J. Bona, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided.
