Citation Nr: 21009372 Decision Date: 02/22/21 Archive Date: 02/22/21 DOCKET NO. 19-34 174 DATE: February 22, 2021 ORDER Entitlement to service connection for an acquired psychiatric disorder other than posttraumatic stress disorder (PTSD) is dismissed. FINDING OF FACT The RO granted service connection for bipolar I disorder with attention-deficit/hyperactivity disorder, predominantly inattentive presentation depressed, in a December 2020 rating decision. CONCLUSION OF LAW There being no justiciable case or controversy, the Veteran’s service connection claim is dismissed. 38 U.S.C. § 7105. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Navy from July 1997 to July 2000. This matter was previously before the Board in November 2020 when it was remanded for additional development. 1. Entitlement to service connection for an acquired psychiatric disorder other than PTSD. In a December 2020 rating decision, the RO expanded the scope of the Veteran’s service-connection psychiatric disorder from PTSD to include PTSD with bipolar I disorder and attention-deficit/hyperactivity disorder, predominantly inattentive presentation depressed. Thus, the Veteran’s claim of entitlement to service connection for an acquired psychiatric disorder other than PTSD is moot as the benefits sought on appeal are already in effect. See Baughman v. Derwinski, 1 Vet. App. 563, 566 (1991). STEVEN D. REISS Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board J.
