Citation Nr: 21010182 Decision Date: 02/24/21 Archive Date: 02/24/21 DOCKET NO. 15-22 232 DATE: February 24, 2021 REMANDED Entitlement to service connection for a low back condition is remanded. Entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU) is remanded. REASONS FOR REMAND The Veteran had active service from May 1981 to October 1983. In August 2018, the Veteran testified at a videoconference hearing before a Veterans Law Judge (VLJ). However, a transcript was unable to be produced and the Veteran was offered the opportunity to testify at another hearing. After electing to have another hearing, in February 2021, the Veteran testified at a virtual tele-hearing before the undersigned VLJ. 1. Entitlement to service connection for a low back condition and entitlement to a TDIU are remanded. Review of the record shows that additional VA treatment records and VA examination reports, which are potentially relevant to the issues currently on appeal, have been added to the claims file since the April 2015 statement of the case (SOC). Although at the hearing the Veteran’s representative initially waived initial AOJ (agency of original jurisdiction) review of these records/reports, after further discussion, he later withdrew the waiver. 38 C.F.R. § 20.1305(c). Accordingly, these matters must be remanded for initial AOJ review of the additional evidence. The matters are REMANDED for the following action: Review the additional VA treatment records and VA examination reports added to the claims file since the issuance of the April 2015 SOC, as well as any other evidence that may be obtained after that date, and after conducting any additional development indicated, readjudicate the claims. A. ISHIZAWAR Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board D. Casula The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
