Citation Nr: 21011454 Decision Date: 03/01/21 Archive Date: 03/01/21 DOCKET NO. 10-38 626 DATE: March 1, 2021 ORDER Service connection for left hip arthritis, to include as a residual of a shell fragment wound of the left buttock, or as secondary to service-connected residuals of such wound, including muscle injury, has been withdrawn; the appeal is dismissed. Service connection for a left lower extremity disability, including left leg venous insufficiency, to include as a residual of a shell fragment wound of the left buttock, or as secondary to service-connected residuals of such wound, including muscle injury, has been withdrawn; the appeal is dismissed. FINDING OF FACT In February 2020, the Veteran submitted a signed and dated statement, expressing satisfaction with his current disability rating and indicating that he wished to withdraw all of the remaining issues associated with his appeal, as contained in his February 2020 Supplemental Statement of the Case (SSOC). CONCLUSIONS OF LAW 1. The criteria for withdrawal by the appellant of his appeal for service connection for left hip arthritis, to include as a residual of a shell fragment wound of the left buttock, or as secondary to service-connected residuals of such wound, including muscle injury have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. 2. The criteria for withdrawal by the appellant of his appeal for service connection for a left lower extremity disability, including left leg venous insufficiency, to include as a residual of a shell fragment wound of the left buttock, or as secondary to service-connected residuals of such wound, including muscle injury, have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran had active duty service from June 1967 to January 1969, to include service in the Republic of Vietnam. His decorations include the Combat Action Ribbon and the Purple Heart Medal. Most recently, the Veteran’s appeal was remanded in March 2019; that development has since been completed and the appeal returns for additional appellate review. In relation to the March 2019 Board decision, the Board has recharacterized the issues on appeal, for the sake of clarity only. The Board recognizes that the Veteran testified at a video-conference hearing in March 2016 before a Veterans Law Judge who has since retired. The Veteran was provided an opportunity to testify again before the undersigned Veterans Law Judge, and given thirty days to respond. As VA has not received a response, VA presumes that the Veteran has elected not to testify at a new hearing. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Prior to the promulgation of a decision in this case, in a February 2020 signed statement, the Veteran indicated his desire to withdraw all remaining issues associated with his appeal before the Board, as contained in his February 2020 SSOC. See February 2020 SSOC, February 2020 Appeals Satisfaction Notice (“I am satisfied and wish to withdraw all remaining issues associated with this appeal. By signing this form, I am asking to withdraw all remaining issue(s) contained in my recent Statement of the Case (SOC)/Supplemental Statement of the Case(SSOC) and ask the regional office of jurisdiction to discontinue further development associated with this appeal.”). Accordingly, no allegations of errors of fact or law remain for appellate consideration with respect to these matters. The issues on appeal are therefore dismissed. V. Chiappetta Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board A. Hennessy, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
