Citation Nr: 21012180 Decision Date: 03/03/21 Archive Date: 03/03/21 DOCKET NO. 15-12 812 DATE: March 3, 2021 REMANDED Entitlement to a total disability rating based upon individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty service from September 1982 to July 1986, and from April 1990 to April 1994. Review of the record reflects that further development is necessary. Although the Board sincerely regrets the delay, it is necessary to ensure that there is a complete record upon which to decide the Veteran's claims so that he is afforded every possible consideration. The claims file contains documentation that the Veteran is receiving Social Security benefits. See the July 2020 SSA inquiry results. The SSA inquiry results indicate that the Veteran's entitlement is based on Title II (Social Security Disability Insurance (SSDI)). The SSA inquires do not provide any indication of the conditions upon which the Veteran's SSA claim was based; therefore, the underlying records are potentially relevant to the issue on appeal. There is no indication that SSA records have been requested. When there has been a determination regarding SSA benefits, the records concerning that decision must be obtained, if relevant. Tetro v. Gober, 14 Vet. App. 100, 108-09 (2000); Murincsak v. Derwinski, 2 Vet. App. 363, 372 (1992). In cases where VA is uncertain as to the relevance of the records, such as this case, VA should be guided by the principles underlying the pro-claimant VA system. See Golz v. Shinseki, 590 F.3d 1317, 1323 (Fed. Cir. 2010). As such, remand is necessary to obtain any outstanding SSA disability records. The matter is REMANDED for the following action: Request all relevant records from the Social Security Administration, to include medical records used in deciding any claim for disability benefits. JOHN Z. JONES Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board T. Jarman, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
