Citation Nr: 21013455 Decision Date: 03/09/21 Archive Date: 03/09/21 DOCKET NO. 15-07 047 DATE: March 9, 2021 REMANDED Entitlement to a total disability rating based upon individual unemployability (TDIU) on an extraschedular basis prior to February 3, 2020 is remanded. REASONS FOR REMAND The Veteran had active service from February 1989 to February 1992. In July 2018, the Veteran testified at a Travel Board hearing before the undersigned Veterans Law Judge. A transcript of the hearing has been reviewed. The Board previously remanded this matter in January 2019 and June 2020. In January 2019, the issue of entitlement to a TDIU was remanded pending adjudication of an intertwined claim for service connection for a left ankle disability. The issue of TDIU was remanded in June 2020 to refer consideration of TDIU on an extraschedular basis of the Director of Compensation and Pension. An advisory opinion regarding extraschedular TDIU under § 4.16(b) was obtained in December 2020. A December 2020 rating decision granted entitlement to a TDIU from February 3, 2020. As the December 2020 decision is not a full grant of the benefit sought, the issue of entitlement to a TDIU prior to February 3, 2020 remains on appeal. 1. Entitlement to a total disability rating based upon individual unemployability (TDIU) on an extraschedular basis prior to February 3, 2020 is remanded. A TDIU claim was initially received in July 2013. In that claim, the Veteran reported that he had last worked for a janitorial service in April 2012. In June 2013 correspondence, the Veteran indicated that he was attending training to get a barber’s license. At the Board hearing, the Veteran testified that he was working as a barber. He testified that he could only work part-time due to his left ankle disability, as he could not stand for a prolonged period, and he could not cut hair well due to his medication. A VA examination report dated in September 2019 indicates that he stopped working after undergoing surgery on his left ankle in April 2019. Additional information is necessary, as the records do not show his hours worked and income earned for the period from July 2013 to April 2019. The case is being remanded to obtain a full employment history. The matters are REMANDED for the following action: 1. Obtain from the Veteran his full employment history for the appeal period from July 2013 to February 2020, including the dates of part-time employment and the wages earned during each period of employment. 2. Readjudicate the claim for entitlement to TDIU, on an extraschedular basis, prior to February 3, 2020. JENNIFER HWA Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Catherine Cykowski The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
