REMANDED

Entitlement to an evaluation in excess of 50 percent for service-connected anxiety disorder is remanded.

REASONS FOR REMAND

The Veteran served on active duty from April 1968 to April 1971.

This matter comes before the Board of Veterans’ Appeals (Board) from a January 2014 rating decision by the Department of Veterans Affairs (VA) Regional Office (RO).  The matter was previously remanded by the Board in a June 2019 decision for additional development and has now returned for further appellate review. 

1. Entitlement to an evaluation in excess of 50 percent for service-connected anxiety disorder is remanded.

While additional delay is unfortunate, the Board finds that remand is again warranted before a final determination can be made.

The record suggests that there are outstanding VA treatment records that are potentially relevant to the Veteran’s claim.  Specifically, a June 2020 supplemental statement of the case notes review of VA treatment records dated from January 2017 through November 2019.  While the file does contain treatment records from March 2019 through July 2020, the January 2017 through March 2019 records have not been associated with the file; this must be done.

The matter is REMANDED for the following action:

Undertake appropriate development to associate with the record all available VA treatment records to include missing VA treatment records dated up to March 2019 (see above).
