Citation Nr: 21014530 Decision Date: 03/12/21 Archive Date: 03/12/21 DOCKET NO. 16-15 116A DATE: March 12, 2021 REMANDED Entitlement to a total disability based on individual unemployability (TDIU) prior to August 22, 2016 is remanded. REASONS FOR REMAND The Veteran served on active duty from September 1979 to September 1983 and from October 1990 to April 1991. In October 2020, the Board most recently remanded the current claim for additional development. Entitlement to a TDIU prior to August 22, 2016 is remanded. In the October 2020 remand, the Board directed that the Regional Office (RO) provide the Veteran with a VA Form 21-8940 (Veteran’s Application for Increased Compensation Based on Unemployability) and to conduct development as may be deemed necessary. In an attempt to comply with the Board’s remand directives, the RO mailed the Veteran a November 2020 development request and attached a VA Form 21-8940. The Veteran did not respond to this request. Significantly, however, the record suggests the Veteran likely changed addresses as early as July 2020. See July 2020 VA Treatment record. Moreover, the November 2020 development request was mailed to a different address than is reflected in Veterans Appeals Control and Locator System (VACOLS). The December 2020 Supplemental Statement of the Case (SSOC) was also mailed to the same address as the November 2020 development request and this document was returned as undeliverable. There is no indication in the record that the RO made another attempt to send the November 2020 development request or the December 2020 SSOC to the correct address of record. In the interest of due process, the Board finds that remand is warranted to attempt to verify the Veteran’s current address and to conduct additional development as indicated below. The matter is REMANDED for the following actions: 1. Attempt to verify the Veteran's current contact information and mailing address. 2. Provide the Veteran with a VA Form 21-8940 (Veteran’s Application for Increased Compensation Based on Unemployability) and ask him to complete and return this form. 3. Conduct any other development as may be deemed necessary. A. ISHIZAWAR Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Metzner, Paul The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
