The Veteran served in the Republic of Vietnam during the Vietnam era. 2. The Veteran’s bladder cancer is presumed to be etiologically linked to his active duty service. CONCLUSION OF LAW The criteria for service connection for bladder cancer have been met. 8 U.S.C. §§ 1110, 1116(a)(2)(J), 5107; 38 C.F.R. §§ 3.303, 3.307. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from September 1967 to May 1971, including service in the Republic of Vietnam from May 1968 to May 1969. In June 2019, the Board remanded this matter for further development. 1. Entitlement to service connection for bladder cancer, to include as due to exposure to herbicide agents. The Veteran contends that his bladder cancer is related to exposure to herbicide agents in service. The record shows that he served in the Republic of Vietnam during the Vietnam Era, therefore, he is presumed to have been exposed to herbicide agents therein. 38 U.S.C. § 1116;38 C.F.R. § 3.307. Post-service private and VA treatment records show that the Veteran was diagnosed with bladder cancer in 2014. The National Defense Authorization Act for Fiscal Year 2021, P.L. 116-283, § 6501, 134 Stat. 3388 (Jan. 1, 2021) recently added bladder cancer to the list of conditions presumptively associated with exposure to herbicide agents. 38 U.S.C. § 1116(a)(2)(J). As the Veteran has a current diagnosis of bladder cancer and in-service exposure to herbicide agents has been conceded, the claim for entitlement to service connection for bladder cancer is granted.
