Citation Nr: 21016111 Decision Date: 03/19/21 Archive Date: 03/19/21 DOCKET NO. 18-20 012 DATE: March 19, 2021 ORDER The issue of whether the Veteran is competent to handle disbursement of Department of Veterans Affairs (VA) funds is dismissed as moot; the full benefit has previously been granted. FINDING OF FACT In a March 2018 rating decision, the VA Regional Office (RO) restored the Veteran’s competency to handle disbursement of VA funds. CONCLUSION OF LAW The issue of whether the Veteran is competent to handle disbursement of VA funds has been rendered moot by the restoration of competency by the RO in a March 2018 rating decision, leaving no question of fact or law to be decided by the Board. 38 U.S.C. §§ 7104 (a), 7105 (2018). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from May 1968 to November 1970. This matter came before the Board of Veterans’ Appeals (Board) on appeal from a November 2015 rating decision of the VA RO. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In the November 2015 rating decision on appeal, the RO found that the Veteran was not competent to handle disbursement of VA funds. Subsequently, in a March 2018 rating decision, the RO restored the Veteran’s competency to handle disbursement of VA funds. As the Veteran’s competency has been restored, there remains no question of fact or law to be decided by the Board concerning the issue of whether the Veteran is competent to handle disbursement of VA funds. Thus, the appeal is dismissed. Kristin Haddock Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Roya Bahrami, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
