Citation Nr: 21020900 Decision Date: 04/08/21 Archive Date: 04/08/21 DOCKET NO. 15-30 995A DATE: April 8, 2021 REMANDED Entitlement to service connection for the cause of the Veteran's death is remanded. REASONS FOR REMAND The Veteran served on active duty from August 1942 to November 1945. The Veteran died in August 2003 and the appellant is his surviving spouse. This matter comes to the Board of Veterans' Appeals (Board) from a June 2013 rating decision by the Department of Veterans Affairs (VA) Regional Office (RO). In October 2019, the Appellant testified before the undersigned VLJ at a Board hearing; a transcript of the hearing has been associated with the Veteran's record. In January 2020, the Board remanded this claim for additional development. However, the Board notes that there are procedural deficiencies with this appeal. Notably, the Appellant's attorney was not provided a copy of the January 2021 supplemental statement of the case and 90-day letter dated February 2021, based on returned mail dating back to August 2019. Accordingly, the Board is remanding this claim so that VA can send a copy of the January 2021 supplemental statement of the case and new 90-day letter to the attorney of record at his new office address. The matter is REMANDED for the following action: VA must send a copy of the January 2021 supplemental statement of the case and new 90-day letter to the Veteran’s attorney of record at his new office address, which is 52 Haddonfield-Berlin Road, Suite 3000, Cherry Hill, NJ 08034. Michael J. Skaltsounis Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board A. R. Montalvo, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
