Citation Nr: 21021510 Decision Date: 04/13/21 Archive Date: 04/13/21 DOCKET NO. 15-06 813A DATE: April 13, 2021 REMANDED Entitlement to a total disability rating based on individual unemployability for accrual purposes is remanded. REASONS FOR REMAND The Veteran served on active duty in the U.S. Army from April 1981 to December1982. The Appellant is the Veteran’s surviving spouse, as he was substituted in the appeal after the Veteran died in June 2020. This appeal was last before the Board in September 2019 when the issues of service connection for a low back disorder and service connection for major depressive disorder, as well as the TDIU issue, were remanded for additional development. As the Agency of Original Jurisdiction (AOJ) issued a rating decision granting service connection for the Veteran’s low back condition and for her major depressive disorder in February 2021, these issues are no longer before the Board. The TDIU issue remains on appeal and must be remanded for additional development. 1. Entitlement to a total disability rating based on individual unemployability for accrual purposes is remanded. The Board finds that additional development is necessary as the record does not contain relevant information regarding the Veteran’s work history. In particular, the Board notes that the file does not contain a VA Form 21-8940: Veteran’s Application for Increased Compensation Based on Unemployability. Of note, VA treatment records show that she was unemployed and had been unemployed for several years, see August 2017 treatment notes, however, no details of the Veteran’s work history were provided. Accordingly, the Board finds that a remand is necessary to obtain relevant work history information for the proper adjudication of the TDIU claim. The matters are REMANDED for the following action: 1. Provide the Appellant with appropriate notice regarding the TDIU claim and request that he complete a VA Form 21-8940, Veteran’s Application for Increased Compensation Based on Unemployability, detailing the Veteran’s work history. Explain what is needed to establish entitlement to TDIU based on the Veteran’s service-connected disabilities. (Continued on the next page)   2. Then, readjudicate the TDIU claim. T. REYNOLDS Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board L. Nelson The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
