Citation Nr: 21021724 Decision Date: 04/13/21 Archive Date: 04/13/21 DOCKET NO. 15-10 823 DATE: April 13, 2021 REMANDED Entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from November 1967 to January 1969. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a July 2012 rating decision. In February 2019, the Board remanded this matter as intertwined with the Veteran’s claim for an increased rating for his left ankle disability and his claim to reopen a claim of entitlement to service connection for a left foot and leg disorder. At the time of the February 2019 Board remand, the Veteran had filed a notice of disagreement but had not yet received a statement of the case. Since the February 2019 Board remand, the Veteran has received a statement of the case on those issues and did not perfect an appeal. 1. Entitlement to a TDIU is remanded. The Veteran seeks TDIU on an extraschedular basis based on his service-connected left lower extremity and left ankle disabilities. The Veteran’s most recent VA examinations for his left ankle in July 2014 and for his left lower extremity venous statis and varicose veins in May 2015 do not support a grant of TDIU. However, the Veteran has reported that his conditions have worsened in severity and prevent him from seeking and maintaining gainful employment. See March 2017 Notice of Disagreement; December 2018 Brief. The Veteran’s representative specifically requested that if the TDIU claim was not granted on the evidence of record that the claim should be remanded for new VA examinations regarding the current level of impairment from his service-connected disabilities. See December 2018 Brief. In light of the suggestions of worsening, the Board finds that new VA examinations are needed to determine the current functional impairment from the Veteran’s service-connected disabilities so that the Board may fully and fairly evaluate the Veteran’s TDIU claim. See Snuffer v. Gober, 10 Vet. App. 400, 402-03 (1997) (holding that a veteran is entitled to a new VA examination where there is evidence that the condition has worsened since the last examination). While this matter is on remand, any outstanding treatment records should be obtained, including any VA treatment records from June 2020 to the present. The matters are REMANDED for the following action: 1. Obtain any additional VA treatment records, to include VA treatment records from June 2020 to the present. 2. After outstanding treatment records are obtained to the extent possible, schedule the Veteran for an appropriate VA examination to determine the current severity of his service-connected left ankle and left lower extremity venous statis and varicose veins disabilities. The entire claims file should be reviewed by the examiner and any appropriate tests conducted. The VA examiner should provide a full description of the Veteran’s disabilities with all symptoms and functional impairment and discuss the effect of the Veteran’s disabilities on any occupational functioning and activities of daily living. 3. After the above development, and any additionally indicated development, has been completed, readjudicate the issue on appeal. Shereen M. Marcus Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board A. Purcell The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
