Citation Nr: 21021833 Decision Date: 04/14/21 Archive Date: 04/14/21 DOCKET NO. 15-09 203 DATE: April 14, 2021 REMANDED An increased disability rating higher than 20 percent for the service-connected right shoulder disability from July 3, 2013 to April 26, 2019 is remanded. REASONS FOR REMAND The Veteran, who is the appellant, served on active duty from October 1980 to October 2000. The rating decision on appeal was issued in April 2014. In a February 2020 decision, the Board denied the increased rating appeal for the service-connected right shoulder disability. The Veteran appealed the February 2020 Board decision to the United States Court of Appeals for Veterans Claims (Court or CAVC). In November 2020, the Veteran and the Secretary of VA (parties) filed a Joint Motion for Partial Remand (JMPR) with respect to the appeal and remanded the appeal back to the Board. The parties agreed that the March 2014 VA examination relied upon by the Board to deny an increased rating for the right shoulder disability prior to April 26, 2019 was inadequate because it did not note whether there was evidence of pain with weight-bearing and the examiner did not elicit relevant information regarding loss of use during flare-ups and estimate functional loss based on all the evidence of record or explain why he could not do so. The November 2020 Joint Motion orders the Board to provide a new VA examination that considers the medical history, including potential loss of motion on weight-bearing and provides an assessment of any previous and current functional loss due the service-connected right shoulder disability; therefore, a remand is necessary to comply with the order. The matter is REMANDED for the following action: Schedule the appropriate VA examination to help assess the current nature and severity of the right shoulder disability. All relevant documents should be made available to and reviewed by the examiner. The examiner should confirm that the record was reviewed. The examiner should consider the medical history, address potential pain and loss of motion on weight-bearing and/or during flare-ups, and provide an assessment of any previous and current functional loss due to the service-connected right shoulder disability based on the evidence of record or explain why he/she is unable to do so.
