Citation Nr: 21023874 Decision Date: 04/21/21 Archive Date: 04/21/21 DOCKET NO. 19-08 521 DATE: April 21, 2021 REMANDED Entitlement to an initial rating in excess of 70 percent for unspecified trauma and stressor related disorder is remanded. Entitlement to a total disability based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from January 1966 to January 1968. In November 2020, the Board remanded the increased rating claim for unspecified trauma and stressor related disorder to obtain a VA examination and the TDIU claim to obtain information regarding employment and income history. The Board also instructed that the Agency of Original Jurisdiction (AOJ) should then readjudicate the appeal. In December 2020, the AOJ procured a VA examination and medical opinion to evaluate the Veteran’s psychiatric disorder and, in a December 2020 rating decision, readjudicated the increased rating claim for unspecified trauma and stressor related disorder. Following the December 2020 rating decision, however, the AOJ appears to have conducted additional development. Despite the addition of relevant evidence, the AOJ has not otherwise provided a Supplemental Statement of the Case (SSOC) to readjudicate the issues on appeal. As such, the Board finds that there has not been substantial compliance with the November 2020 Board remand. See Stegall v. West, 11 Vet. App. 268, 271 (1998). The Board also emphasizes that, under 38 C.F.R. § 19.31, when the AOJ develops evidence pursuant to a remand from the Board, the AOJ must issue a SSOC. Accordingly, remand is warranted for the AOJ to issue an SSOC that addresses this appeal. The matters are REMANDED for the following action: Readjudicate the remanded issues on appeal. If any decision is adverse to the Veteran, issue an SSOC and allow the applicable time for a response. A. ISHIZAWAR Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Metzner, Paul The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
