Citation Nr: 21024021 Decision Date: 04/21/21 Archive Date: 04/21/21 DOCKET NO. 16-14 260 DATE: April 21, 2021 ORDER Entitlement to service connection for bruxism is dismissed. Entitlement to an increased evaluation for traumatic urethral stricture, status post urethrotomy, is dismissed. FINDINGS OF FACT 1. Prior to promulgation of a decision in the appeal, the Veteran indicated in a March 2019 statement, through his authorized representative, that he would like to withdraw his appeal regarding entitlement to service connection for bruxism. 2. Prior to promulgation of a decision in the appeal, the Veteran indicated in a March 2019 statement, through his authorized representative, that he would like to withdraw his appeal regarding entitlement to an increased evaluation for traumatic urethral stricture, status post urethrotomy. CONCLUSIONS OF LAW 1. The criteria for dismissal of entitlement to service connection for bruxism have been met. 38 U.S.C. § 7105; 38 C.F.R. §§ 20.204, 20.205. 2. The criteria for dismissal of entitlement to an increased evaluation for traumatic urethral stricture, status post urethrotomy, have been met. 38 U.S.C. § 7105; 38 C.F.R. §§ 20.204, 20.205. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran served on active duty in the United States Air Force from December 1991 to March 1995 and July 1998 to July 2014. The Board notes that the Veteran filed a Notice of Disagreement (NOD) in October 2015 for four issues including an increased evaluation for traumatic urethral stricture and service connection for bruxism, left wrist tendonitis, and right wrist tendonitis. The Veteran testified during a June 2016 hearing before a Decision Review Officer (DRO) whereby he withdrew his claims for service connection for left and right wrist tendonitis. The Veteran did not include those issues in his VA Form 9 and those issues were not certified to the Board. Therefore, the only issues before the Board are entitlement to service connection for bruxism and an increased rating for traumatic urethral stricture, status post urethrotomy. An October 2015 rating decision denied the Veteran’s claim for service connection for bruxism and granted service connection with a noncompensable evaluation for voiding dysfunction associated with traumatic urethral stricture, status post ureterotomy, effective August 1, 2014. An August 2018 rating decision increased the evaluation of voiding dysfunction associated with traumatic urethral stricture to 10 percent effective June 14, 2016. 1. Entitlement to service connection for bruxism 2. Entitlement to service connection for traumatic urethral stricture, status post urethrotomy, Under 38 U.S.C. § 7105, the Board may dismiss any appeal which fails to allege a specific error of fact or law in the determination being appealed. A substantive appeal may be withdrawn in writing at any time before the Board promulgates a decision. 38 C.F.R. §§ 20.202, 20.204(b). Except for appeals withdrawn on the record at a hearing, appeal withdrawals must be in writing. 38 C.F.R. § 20.204(c). Withdrawal may be made by the Veteran or by his or her authorized representative. 38 C.F.R. § 19.55. In the present case, the Board received a March 2019 statement from the Veteran’s representative indicating that the Veteran was satisfied with the August 2018 rating decision increasing his evaluation for voiding dysfunction associated with traumatic urethral stricture to 10 percent and wished to withdraw his appeals, to include the increased rating claim and the claim for service connection for bruxism. As the Veteran is represented and they reached the decision jointly, he is presumed to be aware of the effects of this action. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. MICHAEL D. LYON Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board L.
