Citation Nr: 21024122 Decision Date: 04/22/21 Archive Date: 04/22/21 DOCKET NO. 16-21 904 DATE: April 22, 2021 REMANDED Entitlement to service connection for cause of death is remanded. REASONS FOR REMAND The Veteran had active service in the Air Force from June 1960 to January 1963. He died in March 2015, and the appellant is his surviving spouse. The appeal originates from a May 2015 decision of a Department of Veterans Affairs (VA) Regional Office. It is noted that in addition to the present appeal, there is a separate pending appeal of service connection for prostate cancer, which was the cause of the Veteran’s death. That appeal was most recently remanded in May 2020 for additional development and is not before the Board. The matter addressed herein is service connection for cause of death, which was remanded in October 2018. Entitlement to service connection for cause of death is remanded. As discussed in the October 2018 Remand, the appellant is seeking service connection for both prostate cancer and cause of death. In October 2018, the Board directed that the service connection claim for cause of death be readjudicated following development of the service connection claim for prostate cancer, as the issues are inextricably intertwined. The record reflects that the development requested in the May 2020 Remand for the prostate cancer claim is still underway. As such, it would be premature to adjudicate service connection for cause of death, and the matter must be remanded at this time. The matter is REMANDED for the following action: After development for the claim of service connection for prostate cancer is complete (per the May 2020 Remand) and the claim has been readjudicated, readjudicate the claim of service connection for cause of death. MICHAEL A. HERMAN Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board M. Alhinnawi The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
