REMANDED

Entitlement to a rating in excess of 10 percent for pes planus prior to November 27, 2018 is remanded.

Entitlement to service connection for hemorrhoids is remanded.

Entitlement to service connection for anemia is remanded.

REASON FOR REMAND

The Veteran had active duty for training (ACDUTRA) from September 1987 to December 1987.  He also had additional periods of National Guard and Reserve service.

This matter comes back before the Board of Veterans’ Appeals (Board) on remand from the United States Court of Appeals for Veterans Claims regarding a Board decision rendered in September 2019.  A November 2020 Order of the Court implemented a Joint Motion for Partial Remand vacating and remanding that portion of the Board decision that denied an increased rating in excess of 10 percent for pes planus prior to November 27, 2018; service connection for hemorrhoids; and service connection for anemia.

In November 2020, the Board informed the Veteran of the Court’s decision and explained that he had an opportunity to submit new evidence.  An evidence response form was enclosed with the letter.  In April 2021, VA received the completed form from the Veteran, along with additional evidence.  On the form, the Veteran requested agency of original jurisdiction (AOJ) review of the evidence.  As such, the Board must remand this claim in order for the AOJ to review this new evidence in the first instance as requested by the Veteran.

The matter is REMANDED for the following action:

Review all new evidence submitted since the January 2019 statement of the case, to specifically include the evidence received in April 2021.
