Citation Nr: 21025889 Decision Date: 04/29/21 Archive Date: 04/29/21 DOCKET NO. 10-23 126 DATE: April 29, 2021 REMANDED The issue of entitlement to a compensable rating for left eye mild proptosis and vitreous strands is remanded. REASONS FOR REMAND The Veteran served on active duty from February 1986 to November 1991. The Board previously remanded the issue for further development in February 2018, October 2019, and October 2020. The case has now been returned to the Board for appellate review. The Veteran testified before the undersigned Veterans Law Judge during an October 2017 videoconference hearing; a transcript is of record. The issue of entitlement to a compensable rating for left eye mild proptosis and vitreous strands is remanded Another remand is required for an addendum opinion because a January 2021 VA examination, obtained per the October 2020 remand, contains an unexplained finding that is pertinent to determine the current severity of the Veteran’s service-connected eye disability. The visual field test was conducted during the January 2021 VA examination. The visual field test results were reported in a Goldmann chart, which is associated with the claims file. According to the chart, it appears that the Veteran has remaining visual field between 46 to 60 degrees in both eyes, which warrants a 10 percent rating for bilateral eyes under Diagnostic Code 6080, 38 C.F.R. § 4.79. However, the examiner noted in the report that the Veteran did not have a documented visual field defect. This finding is on its face inconsistent with a compensable visual field contraction noted in the Goldmann chart, and the examiner did not explain the finding. Moreover, an opinion as to whether the contraction of visual field is related to his service or secondary to his service-connected eye disability has not been provided. As such, upon remand, the Agency of Original Jurisdiction (AOJ) must obtain an addendum opinion addressing this issue. The matters are REMANDED for the following action: Obtain an addendum opinion from an appropriate clinician regarding whether the Veteran’s visual field contraction, if any, is at least as likely as not (1) related to his service, to include the in-service motor vehicle accident or residual thereof; or (2) proximately due to or aggravated beyond its natural progression by service-connected disability, to include his service-connected left eye mild proptosis and vitreous strands. In addition, the examiner must convert the results of January 2021 visual field test reported in a Goldmann chart to a table format, as found in the visual fields section of an Eye Conditions Disability Benefits Questionnaire that was used to report the January 2021 examination. A full and complete rationale for all opinions expressed must be provided. T. REYNOLDS Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Y. Taylor The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
