Citation Nr: 21025898 Decision Date: 04/29/21 Archive Date: 04/29/21 DOCKET NO. 14-30 372 DATE: April 29, 2021 REMANDED Entitlement to special monthly compensation (SMC) based on the need for aid and attendance or by reason of being housebound is remanded. REASONS FOR REMAND The Veteran had active service from October 1963 to November 1966. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). In June 2019, the Veteran testified before the undersigned Veterans Law Judge (VLJ) at a Travel Board hearing. A transcript of his testimony is of record. This matter was last before the Board in November 2020, when it was remanded for additional development. 1. Entitlement to SMC based on the need for aid and attendance or by reason of being housebound i is remanded. Unfortunately, there has not been substantial compliance with the Board’s previous remand directives. The November 2020 remand directed that various scanned records be associated with the claims file. While many of the requested records were obtained on remand, there still appear to be outstanding scanned records. Specifically, VA record entries from December 5, 2013, December 20, 2013, and December 21, 2013 indicate that outpatient treatment and emergency room records from September 22, 2013 had been scanned. A VA record entry from December 18, 2013 indicates that “hm-hha” records from November 10, 2013 to November 11, 2013 had been scanned. A VA record entry from December 26, 2013 indicates that “hm” records from November 13, 2013 had been scanned. VA record entries from December 31, 2013 and January 23, 2014 indicate that outpatient fee basis records from November 18, 2013 had been scanned. A January 7, 2014 VA record entry indicates that “hha” records from November 20, 2013 to November 26, 2013 had been scanned. A June 8, 2014 VA record entry indicates that “fee HM/HHA” records from November 10, 2013 to December 4, 2013 had been scanned. VA record entries from July 21, 2015, August 17, 2015, November 10, 2015, December 4, 2015, and March 17, 2016 indicate that fee basis inpatient treatment records from June 29, 2015 and June 30, 2016 had been scanned. A January 14, 2019 VA entry indicates that fee basis records from July 31, 2018 had been scanned. VA record entries from January 28, 2019 indicate that an episode report from October 7, 2018 and multiple records from “BHMG” from August 31, 2018 to September 10, 2018 had been scanned. A January 31, 2019 record indicates that an outside physician order from October 8, 2018 had been scanned. It does not appear that the above records have been associated with the claims file. Accordingly, a remand is required. Stegall v. West, 11 Vet. App. 268, 271 (1998). Additionally, the evidence indicates there may be outstanding relevant VA treatment records. VA record entries from January 20, 2021 and December 22, 2020 note that skilled home health records had been scanned into VistA Imaging. The referenced records have not been associated with the claims file. A remand to obtain the outstanding records is required. The matters are REMANDED for the following action: Obtain updated VA treatment records dated since January 20, 2021 as well as the VistA Imaging records referenced in the December 5, 2013, December 20, 2013, December 21, 2013, December 18, 2013, December 26, 2013, December 31, 2013, January 23, 2014, January 7, 2014, June 8, 2014, July 21, 2015, August 17, 2015, November 10, 2015, December 4, 2015, March 17, 2016, January 14, 2019, January 28, 2019, and January 31, 2019 VA record entries. If any requested records are unavailable, the Veteran should be notified of such. K. A. BANFIELD Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board J. Anderson The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
