Citation Nr: 21027765 Decision Date: 05/06/21 Archive Date: 05/06/21 DOCKET NO. 17-40 799 DATE: May 6, 2021 REMANDED A rating higher than 20 percent for residuals of a fractured left big toe is remanded. REASONS FOR REMAND The Veteran served on active duty from January 1967 to December 1970. He is the recipient of the Combat Action Ribbon. In February 2021, the Veteran testified before the undersigned Veterans' Law Judge; a copy of the transcript is made a part of the record. In his hearing testimony, the Veteran stated that a VA examination in September 2020 did not include a physical examination of his left toe. Based on the Veteran's testimony, the Board finds that a more current examination which specifically addresses the Veteran's service connected left great toe is warranted. The matter is REMANDED for the following action: Schedule the Veteran for an examination by an appropriate clinician to determine the current severity of his service-connected left great toe disability. The examiner should provide a full description of the disability and report all signs and symptoms necessary for evaluating the Veteran's disability under the rating criteria. The examiner should consider the Veteran's lay testimony in his February 2021 hearing regarding his left great toe pain, swelling, and limitation of motion. JOHN Z. JONES Veterans Law Judge Board of Veterans' Appeals Attorney for the Board A. Parrish, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
