Citation Nr: 21029704 Decision Date: 05/14/21 Archive Date: 05/14/21 DOCKET NO. 19-17 359 DATE: May 14, 2021 REMANDED A rating higher than 20 percent for a right knee meniscal tear is remanded. A rating higher than 20 percent for a left knee meniscal tear is remanded. REASONS FOR REMAND The Veteran served on active duty from March 1984 to March 2004. The matter comes before the Board of Veterans' Appeals (Board) on appeal from December 2017 rating decision by the Regional Office (RO). In May 2021, a hearing was held before the undersigned Veterans Law Judge. A transcript from the hearing will be associated with the file at a later time. During the hearing, the Veteran reported that his knee disabilities have worsened since his last VA examination that was conducted in April 2019. He also described symptoms which indicate that there may be instability of the knees. As such, the Board finds that a remand is necessary to obtain a new VA examination to assess the current severity of the Veteran's service-connected right and left knee disabilities, to include evaluation of knee instability. (Continued on the next page) The matters are REMANDED for the following action: 1. Obtain updated VA treatment records. 2. Schedule the Veteran for a VA examination to assess the current severity of his right and left knee disabilities. JOHN Z. JONES Veterans Law Judge Board of Veterans' Appeals Attorney for the Board A. Hemphill The Board's decision in this case is binding only with respect to the instant matter decided.
